■ MEMORANDUM AND ORDER

ALDRICH, District Judge.

This is an action for review of the defendants’ (“Brunswick’s”) denial of the plaintiffs (“Cablevision’s”) cable franchise renewal. Cablevision seeks relief under 47 U.S.C. § 546(e)(2)(A) and § 546(e)(2)(B), which are part of the Cable Communications Policy Act of 1984 (the “Act”). Brunswick has moved that this Court dismiss the claim under § 546(e)(2)(A) for lack of subject matter jurisdiction. For the reasons that follow, this Court denies Brunswick’s motion (docket no. 20).
