In a proceeding pursuant to CPLR article 78, inter alia, to review the 1979 assessment on certain real property, the Assessors of the Town of Ossining and Village of Briarcliff Manor and the town and village appeal from an order of the Supreme Court, Westchester County (Sullivan, J.), entered December 3, 1982, which denied their respective motions to dismiss the instant proceeding as untimely. Leave to appeal is granted by Justice Mangano. Order modified by converting this article 78 proceeding into an action for moneys had and received.
