SANBORN, Circuit Judge.

About 2 o’clock in the afternoon on October 26, 1890, engine No. 5 of the Tittle Rock & Memphis Railroad Company ran into the rear of a freight train on the railroad of that company; and Gt. F. Barry, the defendant in error, who was the iireman on this engine, leaped from it, and was injured.
