This case comes before this Court upon a petition by the Trustee in Bankruptcy for review of an order of the Referee in Bankruptcy upholding the validity of a chattel mortgage claimed by Clement D’Andria on property of the bankrupt. The Trustee challenged the validity of the mortgage on the ground that it was not recorded “within fifteen days from the date written in the mortgage,” as required by Massachusetts General Laws (Ter.Ed.) chapter 255, § 1, in that it was recorded on February 17, 1954, but contained as the only recitation of its date of execution the…
