I. INTRODUCTION

Yerania Martell DeLuca (“DeLuca”) is a 24 year old citizen of Mexico who has been living in the United States since April 25, 1994 as a permanent resident. On September 2, 1998, DeLuca applied for naturalization with the Immigration and Naturalization Service (“INS”). The application was denied by the INS on August 7, 2000.
