The facts in this case sufficiently appear in the opinion of the court, delivered by Ewing, 0. J.

This case comes before us by certiorari to the Court of Common Pleas of the county of Essex. The plaintiffs prosecuted a suit in the court for the trial of small causes, on a promissory noté given to them by the defendant. Judgment having been rendered there against them, they appealed, and on the trial of the appeal the Court of Common Pleas also rendered judgment for the defendant.
