BLAKE, District Judge.
Provident Life and Accident Insurance Company (“Provident”) filed an amended complaint on July 26, 2000 seeking to recover money paid to Melvyn Cohen under a disability insurance policy. In its Order dated March 29, 2001, the Court held that the state law claims in Counts One through Five of the amended complaint are preempted by the Employee Retirement Income Security Act (“ERISA”), 29 U.S.C. § 1001 et seq.
