This was a suit in assumpsit brought by plaintiff in error against defendant in error wherein a demurrer to plaintiff’s declaration was sustained and judgment rendered against him for costs. To reverse that judgment he has brought the case to this court by writ of error. After a demurrer had been sustained to the original declaration, a new one was filed, which contained three special counts, and a consolidated common count for the price and value of certain horses sold by plaintiff at the request of defendant.
