This is a proceeding under article 78 of the Civil Practice Act to review a determination of respondent suspending petitioner’s license to practice dentistry on the ground that in two instances he aided and abetted in the practice of this profession an unlicensed practitioner and on the further ground that he was guilty of unprofessional conduct.

Section 1300 of the Education Law, as it existed at the time of the alleged commission of the unlawful acts, in defining what constitutes the practice of dentistry, read: “ A person practices dentistry within the meaning of this article, who holds…
