Appeal, by permission, from a judgment of the Supreme Court at Special Term, entered February 28, 1973 in Albany County, which granted petitioner’s application, in a proceeding pursuant to CPLR article 78, to annul a determination of the Acting Commissioner of Education, Gordon M. Ambach. Petitioner, a duly qualified and certified school psychologist, was first employed by the respondent Board of Education on a part-time basis in 1959. In 1961 she became a full-time school psychologist, for which position she was granted tenure by the board in 1963. She remained in this post until September…
