The defendant, who is the appellant herein, was on the 21st day of November, 1903, accused by information duly presented by the fiscal of the Hnmacao district, which reads as follows:

“The undersigned fiscal (prosecuting attorney) appears before the above-mentioned tribunal and in due form respectfully alleges: That Francisco Rivera, alias ‘ Panchito, ’ on the 15th day of July of the year 1902, within the said judicial district, illegally and with malice aforethought intentionally killed and assassinated Severo Lorenzo by shots and with a revolver.
