OPINION
LYDON, Senior Judge:
This matter is before the court on plaintiff’s motion to dismiss its complaint, pursuant to RUSCC 41(a), which defendant opposes, and defendant’s motion for leave to file an amended answer and counterclaim. Plaintiff’s motion to dismiss was filed with the court on February 13, 1991. *854Defendant’s motion for leave to file a counterclaim was filed with the court on February 14, 1991.
