Appeal from an order of the Supreme Court, Erie County (Nelson H. Cosgrove, J.), entered April 27, 2004. The order, insofar as appealed from, denied the motion of defendant Lehigh Construction Group, Inc. for summary judgment dismissing the complaint and cross claims against it and granted that part of plaintiffs cross motion for partial summary judgment on the issue of liability on the Labor Law § 240 (1) claim.
