Goodbar Page, a copartnership composed of J. H. Goodbar and F. E. Page, contracted to construct a school building for the Trinidad independent school district, and executed the bond required by article 5160, R.S. 1925, providing for payment of all labor and material used in the construction of the building, with appellant Royal Indemnity Company as surety. The building was completed and accepted, but at the time there were several unpaid claims for labor and material.
