MAJOR, Chief Judge.

Two complaints were filed, each ' by a number of plaintiffs as purchasers from the defendants of family dwelling units built under Priorities Regulation 33 (11 F.R. 4085), in which a mandatory injunction was sought, requiring defendants to make restitution to each of the plaintiffs for sums allegedly paid in excess of the approved maximum sales price. Defendants moved to dismiss each of the complaints for failure to state a cause of action. Such motions having raised the same questions as to each complaint, the causes were consolidated.
