Appellant operated a coal mine in Seatonville, Bureau county, Illinois, in which appellee was employed as a driver, working nights. On one of his trips on the evening of August 14, 1906, a quantity of rock and earth fell upon him from the roof, inflicting serious injuries upon him. To recover damages for these injuries, he brought this suit. The amended declaration contained four counts.
