Defendant reviews by writ of error a judgment recovered by plaintiff under the Federal employers’ liability act for damages for injuries sustained by him in a collision between two trains on the defendant road. An extra freight train (No. 1114) left Saginaw at 3 p. m. on January 12, 1923, for Toledo in the State of Ohio. The crew consisted of Engineer Salow, Fireman Yerebeck, Conductor Elliott, rear Brakeman Fredericks, and plaintiff as head brakeman.
