On October 9, 1917, Daniel W. Phelan, now deceased, and his wife, Jnniata A. Phelan, entered into a written contract with plaintiff, Dineris, by the terms of which Phelan and wife, as parties of the first part agreed to sell, and Dineris agreed to buy certain real property located in Midvale, Salt Lake county, Utah. Under the terms of the agreement an initial payment was made, and the balance of the contract price was to be paid in monthly instalments of $250 each. Daniel W.
