Defendant was tried and convicted by a jury of the crime of second degree assault. From the judgment and sentence entered thereon he appeals and assigns as error the refusal of the trial court to give his requested instruction on self-defense.
Girtha L. Currie, defendant’s ex-wife with whom he was living at the time of the offense in question, while returning home from work experienced trouble with her car.
