STEVENS, Circuit Judge.

Eleven days after the complaint was filed the district court dismissed plain*1056tiffs’ entire case on the merits. Their complaint, filed on May 7, 1971, alleged that they had signed a contract to purchase a cooperative apartment for $35,-000 and made an earnest money deposit of $3,500, but were thereafter refused admission to the cooperative because a Negro child lived with them.

On May 10 the district court entered a temporary restraining order and set the hearing on plaintiffs’ motion for a preliminary injunction to commence on May 17. Neither then nor at any later date…
