By bottom-line Order dated December 14, 2015, this Court granted the motion of defendant Saatchi & Saatchi, North America, Inc. (“Saatchi & Saatchi”) and defendant Toyota Motor Sales, U.S.A., Inc. (“Toyota”) to dismiss plaintiffs Complaint alleging that defendants’ media campaign featuring an oversized, pink stuffed animal perched atop a Toyota RAV4 infringed plaintiffs copyright in a strikingly kinetic piece of art featuring a winged, taxider-mied horse bursting through the shredded roof of a car.
