This is an appeal from the judgment following a verdict of guilty.

Defendant was charged by information with the violation of section 68 of the Penal Code. The information alleged the offense substantially in the language of the statute. The evidence established that defendant was employed by the California Department of Motor Vehicles as Drivers’ License Examiner at Los Angeles; that, as such employee, defendant assisted applicants for drivers’ licenses and, in particular, illiterate applicants; that, in this connection, illiterates “took the same tests as any other applicant, with the…
