On January 10, 1934, Russell A. Guy met with an accident while in the course of his employment with Stoecklein Baking Company and was disabled as a result of injuries then sustained. The claim petition which initiated this action was not filed until May 20, 1935, more than sixteen months after the accident. The sole defense interposed and now relied upon was that the action was barred by reason of the fact that it was not started within one year after the accident as required by the statute under which the claim was made.
