Bell, Presiding Justice.

1. Where a husband and his wife were divorced by a decree in the State of Elorida, and as a part of the decree the custody of their infant son was awarded, with the consent of the husband, to the wife, and where in subsequent litigation in the State of Georgia, between the father and another person who claims to have adopted the child with the-consent of the mother after such decree, no statute of the State of Elorida is pleaded, the question as to the effect of such award of custody on the rights of the father must be determined by the law of the forum.
