CHATFIELD, District Judge.

This is an action to enjoin the alleged infringement of copyright. Both parties have been taking testimony before special examiners in several places. Upon a hearing before special examiner in the city of St. Paul, state of Minnesota, a witness employed as a shipping clerk for the complainant was questioned as to his methods of shipment of the various books published by the complainant. He testified that it was his custom, under instructions, to ship the first two copies of each volume published to the Librarian of Congress at Washington, D. C. On cross-examination…
