Appeal from an order of the Family Court of Tompkins County (Rowley, J.), entered May 5, 2009, which, among other things, dismissed petitioner’s application, in a proceeding pursuant to Family Ct Act article 6, to modify a prior order of custody and/or for custody of the subject child.
