Appeal by the respondents from tne taxation of costs by the clerk on the return of a verdict of a sheriff’s jury upon a petitian for the assessment of damages for land taken to wide» a highway in Taunton. The only items objected to were those of the sheriff’s bill of costs, the whole of which was allowed by the clerk. At the hearing before the Superior Court, Dewey, J., disallowed some of the items, and allowed others.

Appeal by the respondents from tne taxation of costs by the clerk on the return of a verdict of a sheriff’s jury upon a petitian for the assessment of damages for land taken to wide» a highway in Taunton. The only items objected to were those of the sheriff’s bill of costs, the whole of which was allowed by the clerk. At the hearing before the Superior Court, Dewey, J., disallowed some of the items, and allowed others. Both parties alleged exceptions, the substance of which is stated in tita opinion.

This is a question of the taxation of costs in th< Superior Court upon the return of the verdict of a sheriff’s jur assessing damages for land taken to widen a highway in Taunton The allowance of the jurors’ fees is not objected to. The other charges in the bill of costs returned by the sheriff may conveniently be grouped under three heads: the personal services of the sheriff; fees for serving precepts; and expenses incident to the trial.
