The appellant brought this action of replevin in the circuit court of Marion county against W. B. Waldrop; sheriff, Warren Bawls, W. E. Warren, Edgar Sluter, and J. !P'. Morman to recover joossession of certain live stock, alleged to have been wrongfully taken from his possession and detained by them. On the trial of the cause, the jury was peremptorily instructed to return a verdict in favor of all the defendants except W. B.
