Tliis suit was brought by the Meacbam Contracting 'Company and the city of Hopkinsville suing for the use and benefit of the contracting company, against the Illinois Central Eailroad Company and the Chicago, St. Louis & New Orleans Eailroad Company to recover $1,-423.95 with interest from December 20, 1912, on account of the construction of a sewer in the city of Hopkins-ville for which the city and the contracting company sought to make the railroad companies liable.
