Mabel Truitt as widow, brought suit in behalf of herself and her four minor children, against the Atlanta & West Point Railroad Company, to recover for the homicide of Bob Truitt, the husband and father respectively of the plaintiffs. The petition was in two counts, the first of which was withdrawn by the court during the trial and now need not be considered. The allegations of the second count, on which questions arose, in substance are as follows: that on November 19, 1939, at about 8 :15 p. m., Bob Truitt was struck and killed by a train of the defendant known as tbe Piedmont Limited; that…
