The answer admitted the organization of the plaintiff county, and denied generally all other allegations of the complaint. A jury was waived. The following facts were admitted and agreed upon by stipulation of the parties: On the 13th of August, 1871, the defendant, who was then the owner of the lands in question, conveyed the same to the plaintiff county by a quitclaim deed, “upon the express condition and term that the said county of Pepin erect thereon within five years a court house for the use…

The deed of the land in question was given to the county by the defendant, August 13, 1871, “upon the express condition and term that the said county of Pepin erect thereon within five years a court house for the use of said county, and shall keep and maintain the same thereon for the space of ten years, upon the express condition.” The *305court house was commenced in 1873, and finished and completed in March, 1874, when the county entered upon and into the possession, use, and occupancy thereof as such court house, and continued to use the same as such until December 15, 1881, when the village…
