This appeal is from an order of the United States District Court for the Eastern District of New York, Eugene H. Nicker-son, Judge, granting judgment on the pleadings to the Secretary of Health and Human Services. The Secretary denied the application of Jackie McBrayer for disability benefits sought under the Federal Coal Mine Health and Safety Act, 30 U.S.C. §§ 903-45 (1976 & Supp. V 1981), as the disabled child of a miner deceased from Black Lung disease.
