ORDER

BUA, District Judge.

This order concerns plaintiffs motion to secure possession by the Department of Housing and Urban Development (HUD) of property which is the subject of a pending foreclosure suit. For the reasons stated herein, plaintiff’s motion is granted.

I. FACTS

The relevant facts do not appear to be in dispute. Defendant Drexel View II, Limited, a California limited partnership (Drexel View), purchased a low and moderate income housing development from HUD in 1980 for $256,500.
