Plaintiff’s petition alleged: On February 12, 1941, defendant executed and delivered to plaintiff a note for $2,250 due February 12, 1951, with interest at five per cent until maturity and seven per cent thereafter, payable at the office of T. M. Fairchild, attorney at law, Iowa City, Iowa, secured by a mortgage upon Lot 5, Block 1, Pleasant Place Addition to Iowa City, Iowa; the mortgage was duly recorded on February 20, 1941on or about March 24, 1941, defendant represented to plaintiff that he had an opportunity to sell the mortgaged premises, it would be necessary for plaintiff…
