Plaintiff, widow of New York State Trooper David Brinkerhoff, commenced a civil action asserting four causes of action as a result of Brinkerhoff s work-related death. In response to this motion, plaintiff has conceded her claims for punitive damages and pain and suffering pursuant to General Obligations Law § 11-106. The defendants are the St. Lawrence County Probation Department, its director, a probation supervisor, and a probation officer.
