Reversing.

On December 17, 1932, a special election was held in Harlan county for tbe purpose of taking tbe sense of the legal voters of the county upon the proposition whether the county should have a fiscal court composed of three commissioners from the county at large and the county judge. A majority of the legal votes cast at the election were in favor of the commission form of government, and the county judge, pursuant to the provisions of section 1847 of the Kentucky Statutes, divided the county into three districts.
