This is the second appeal .in this case. The opinion in the first appeal was handed down in term time and is found in 252 S. W. 255. Since that appeal the appellant has amended its petition and presented it to the trial judge in chambers, praying for a temporary injunction. After notice and upon a full hearing, the trial judge refused to grant the writ and from that order the record is brought to this court in vacation praying that this court review the action of the trial judge, and that the judges of this court grant its writ of injunction, to restrain…
