CARLEY, Justice.

Michael B. Lejeune is charged with malice murder, felony murder, aggravated assault, concealing the death of another, and possession of a firearm during the commission of a felony. The State is seeking the death penalty. We have consolidated three separate appeals arising from pretrial rulings. In Case Number S02A1277, the State appeals from the trial court’s grant of a motion to suppress the evidence seized from Lejeune’s apartment due to an invalid search warrant.
