Jackson Neely (“Movant”) seeks post-conviction relief via a Rule 29.15 motion after he was convicted by a jury of murder in the first degree in violation of section 565.020, RSMo (1994). 1 Movant alleges: (1) his trial counsel was ineffective for failing to rehabilitate a witness by use of a prior consistent statement, and (2) his appellate counsel was ineffective for failing to assert a claim of plain error on appeal regarding Movant’s invocation of his right to remain silent.
