OPINION

{¶ 1} Defendant, William Gavin, appeals from his sentence of ten months confinement imposed by the court of common pleas.

{¶ 2} Defendant pled guilty to one count of possession of less than one gram of cocaine, a fifth-degree felony, in violation of R.C.2925.11(A). He failed to appear at a sentencing hearing on September 10, 2004, due to a death in the family. He did appear for a sentencing hearing on October 15, 2004. The court reviewed the Pre-Sentence Investigation (PSI) report, which recommended community control, but found Defendant not amenable to community control sanctions. The…
