MEMORANDUM OPINION

In this civil action, an insurance company has sued its insured seeking to recover amounts claimed to have been erroneously paid under a policy issued by the insurer. Plaintiff Admiral Insurance Company (“Admiral”) issued a master insurance policy to defendant American National Savings Bank, F.S.B. (the “Bank”). The Bank suffered a loss which it claimed was covered by the policy, and the Bank was later paid $158,000 by Admiral. Claiming that this amount was erroneously paid, plaintiff Admiral has filed a four-count complaint…
