I. INTRODUCTION
Thomas Luckey is charged in a two-count indictment with being a felon in possession of ammunition, and possession with intent to distribute cocaine base. 1 He now moves to suppress physical evidence and statements obtained following a search of 1425 Amsterdam Avenue, apartment 1R, in Manhattan. 2 Without a search warrant, without exigent circumstances, and without permission, law enforcement officers entered this home only on the strength of an arrest warrant for a fugitive.
