MEMORANDUM OPINION

Plaintiff Richard Hatcher filed this action on October 22, 2010, pursuant to the Federal Tort Claims Act, 28 U.S.C. §§ 2671 et seq. Hatcher alleges that on April 23, 2009, while observing rocks in a *730stream located in the Cades Cove picnic area in the Great Smoky Mountains National Park (Park), he was injured when a tree located in a wooded area located across the stream fell and landed on his left leg.
