MEMORANDUM DECISION

HANEN, District Judge.

Pending is Defendant’s appeal to the District Court from a misdemeanor conviction adjudged by a Magistrate Judge. For the reasons set forth below, Defendant’s conviction is AFFIRMED.

I. BACKGROUND

The Defendant was charged with violating an immigration law that prohibits aliens from entering “the United States at any time or place other than as designated by immigration officers.” 8 U.S.C. § 1325(a)(1).
