In a proceeding pursuant to CFLR article 75 to vacate an arbitration award dated February 12, 2003, dismissing the petitioner’s claim for uninsured motorists’ benefits, the petitioner appeals from an order of the Supreme Court, Queens County (Kelly, J.), dated May 20, 2003, which denied the petition.
Ordered that the order is reversed, on the law, with costs, the petition is granted to the extent that the arbitration award is vacated, and the matter is remitted to the Supreme Court, Queens County, for further proceedings consistent herewith.
