Kenna, Judge:

C. E. Jones brought this action of trespass on the case against the Virginian Railway Company in the Common Pleas Court of Kanawha County. From a verdict and judgment for the plaintiff for $2,000.00, defendant prosecutes error. Plaintiff filed a declaration in three counts, averring the circumstances under which he received severe personal injuries in a collision of an automobile in which he was riding with a locomotive of the defendant in the City of Charleston at the Greenbrier Street crossing of defendant’s (same as New York Central’s) line on the morning of September 7, 1932,…
