On September 1, 1937, the defendant Benjamin F. Sieve and Frieda F. Sieve, who were husband and wife and were then living apart, entered into a separation agreement through trustees. At the time the agreement was executed it was contemplated that proceedings for divorce were to be instituted shortly thereafter. On October 29, 1937, the Probate Court for Norfolk County entered a decree nisi (which became absolute six months later) on a libel for divorce brought by Mrs. Sieve.
