Appeals from an order of the Supreme Court (Harris, J.), entered May 25, 1994 in Albany County, which, inter alia, granted a cross motion by E. Smalis Painting Company, Inc. for summary judgment dismissing the complaints in action Nos. 2 and 3 and the third-party complaint in action No. 1.
In April 1984, the State Department of Transportation (hereinafter DOT) awarded a contract to E. Smalis Painting Company, Inc. (hereinafter Smalis) to clean and paint the Skyway Bridge in the City of Buffalo, Erie County. Such contract contained detailed insurance specifications which mandated…
