This is a motion for permission to amend the complaint in an action brought against the defendant to recover an endowment to which plaintiff claims he is entitled upon the death of his wife, under the constitution of the defendant. The constitution of the defendant provides that “ no candidate who is married shall be admitted into the society without his wife,” and that “ each candidate and his wife must be examined by a doctor.” There is no provision made in any of the rules, by-laws or constitution of the de*232fondant as to a member who entered the society when single and afterward married.…
