One Louis Wallerstein was engaged in the wholesale and retail confectionary business in the city of Tacoma, and also dealt in cigars. Esherg, Bachman & Co., of Portland, Oregon, were creditors of the said Wallerstein, on the 26th of June, 1893, to the amount of $2,705. They brought their action to recover the same in the United States district court, and at the same time sued out a writ of attachment which was placed in the hands of the appellant, James C.
